RESERVATIONS & PRICING:

All pricing is in U.S. dollars unless otherwise stated. At time of reservation, we require a 30% deposit (based on the total cost of the trip), and the balance of your payment is due 90 days prior to departure. Should you be booking your trip within 90 days of departure, we will require full payment at time of reservation. We charge individual travellers a single supplement to occupy a single room.

CANCELLATION:

Should the need arise to cancel your reservation, the following fees would apply:

Outside 91 Days: 50% of your deposit
61-90 Days: 30% of the cost of the trip
31-60 Days: 50% of the cost of the trip
0-30 Days: 100% of the cost of the trip

PASSPORTS/VISAS:

Please note that passport & visa requirements may vary depending on the destination and the nationality of the traveller. We will provide, to the best of our ability, the most accurate information, however, ultimately it remains the responsibility of each traveller to ensure they have the appropriate travel documents based on their nationality and travel destination. Costs for Passports and Visas are not included in the cost of the trip and are the responsibility of each individual. TDDC is not liable or responsible for any costs that arise from inaccurate, incomplete or missing travel documents that would prohibit travellers from entering a country as part of a scheduled trip.

TRAVELLERS:

We require that all travellers be a minimum of 18 years of age. Travellers under the age of 18 must be accompanied by an adult/guardian.

INSURANCE:

Insurance coverage is not included in the cost of the trip. We strongly advise that you purchase travel insurance to ensure against any unforeseen circumstances that may arise during or prior to your trip (i.e. medical emergencies, trip cancellation, lost luggage).

Our Luxury Experience Concierge will be happy to assist with any of your travel insurance needs.

TRAVELLER HEALTH & RESPONSIBILITY:

It is your responsibility to consult your doctor prior to departure to ensure you are insufficiently good health to travel as well as receive all appropriate vaccinations when & where necessary based on your proposed trip. There are always inherent risks in any type of travel, however, we ask that you read and make yourself familiar with all pre-trip information to ensure you are prepared. Please note that services & facilities may not be of the same level as those in North America.

TDDC reserves the right to refuse accepting or retaining any traveller whose health or actions, in TDDC’s sole judgement, impedes the operation of a trip or the welfare or enjoyment of fellow travellers. Travellers understand that in the event that they are removed from a trip, they will be sent home at their own expense.

ITINERARY CHANGES/CANCELLATION BY TDDC:

TDDC reserves the right to modify or vary elements of the itinerary based on changing circumstances or situations in the destination. TDDC reserves the right to cancel any trip at our sole discretion, included, but not limited to the fact that there may be too few participants registered on the trip, a travel advisory has been issued for the destination or an Act of God preventing travel.

Limitation of Liability, Release & Indemnity

By accepting these terms and conditions, except where provided or required by law and as such cannot be excluded, travellers agree not to sue TDDC in respect of, and forever release TDDC from any and all liability for economic loss and physical or mental injury, direct or indirect, arising in connection with TDDC services, including, without limitation, permanent disability and death, emotional distress, loss of services, financial support, aid, consortium or companionship, and any damage to or loss of property, including if caused in whole or in part by the conduct or negligence of TDDC, except where such loss, injury or damage is caused by reckless or fraudulent conduct on the part of TDDC or their employees, guides, shareholders, officers or directors, in which case the traveller retains the right to sue TDDC exclusively in respect of that conduct.

TDDC disclaims all responsibility and liability for the action or non-action of any independent contractor or any unrelated third party (each an “Independent Contractor”). The services provided by Independent Contractors are subject to the laws of the place where the services are provided, and any supplemental conditions imposed by the Independent Contractor. The liability of Independent Contractors may be limited by local tariffs, conditions of carriage, tickets and vouchers, and international conventions and agreements. Travellers agree to hold harmless, defend, and release TDDC from any and all liability for any injury or loss, without limitation, resulting from the actions of any Independent Contractors.

TDDC is not responsible for, and the traveller agrees to hold harmless, defend, and release TDDC for any improper or non-performance of any services forming part of the contract which are wholly attributable to the fault or misconduct of the traveller, any other trip participant, the unforeseeable or unavoidable act or omission of a third party unconnected with the provision of any services to be provided under the contract; unusual and unforeseeable circumstances beyond the control of TDDC and/or the relevant supplier, the consequences of which could not have been avoided even if all due care had been exercised including (but not limited to) an event of force majeure; or any event which TDDC and/or the relevant supplier could not with all due care have foreseen or forestalled. Travellers further agree to indemnify and hold harmless TDDC in respect of any claims if damages are recovered from any third parties, to the extent that such third party obtains an indemnification from TDDC, except where the loss, injury, death or damage is caused by the reckless or fraudulent conduct on the part of TDDC, or their employees, guides, shareholders, officers or directors.

Travellers agree to permit TDDC, or their designate, to use any photographic or film records of TDDC trips for purposes including, but not limited to, promotional and/or commercial materials, without any remuneration or compensation to the traveller, and assign all right, title and interest they may have in or to any media in which their name or likeness might be used by TDDC.

This Limitation of Liability, Release and Indemnity is binding upon all members of the traveller’s family, dependants, estate, heirs, successors and legal personal representatives. Any claim or dispute arising out of or relating to this Limitation of Liability, Release and Indemnity or its interpretation, the trip, or the traveller’s relationship with TDDC will be resolved exclusively in the courts of the Province of Ontario and will be governed exclusively by Ontario law.
